§1 General provisions
These Regulations (hereinafter referred to as the “Regulations”) specify the rules of the offer to exchange the MPM-COM model interface for the model Batman_4GEN interface, organized by : MaxiEcu Sp. z oo with its registered office in Gdynia (81-589) at ul. Fleszarowa-Muskat 7, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court of Gdańsk – Pół noc in Gdańsk under the KRS number 0001080295, , NIP: 5862323620, REGON: 36849635500000
Offer valid until further notice .
§2 Definitions
User – a natural person with full legal capacity , being the owner of the MaxiEcu brand interface , who decides to use the offer .
model Batman_4GEN interface/ MPM-COM – an interface with a unique 10 (model Batman_4GEN interface) or 8 (MPM-COM) character serial number, which is the hardware key for a given license, assigned to the User account .
MaxiEcu User Account – an account on the website under the domain www.maxiecu.eu , for which the User has an individual login and password and on which the license data are saved .
Interface replacement – is performed by editing the User Account, during which the MPM-COM model interface is removed along with the license and the model Batman_4GEN interface is added with assignment to the existing license.
Order fulfillment – includes: transfer of MaxiEcu license (2); generation of license for new MaxiEcu for brands from MaxiEcu (2) in accordance with the scope/quantity and type of brands at the time of placing the order by the User; replacement of the interface and shipment of the new interface model Batman_4GEN to the address indicated in the order. The agreement is confirmed by an updated license key and a purchase document issued with the order. Order processing takes place during the opening hours of the organizer’s Sales Department, i.e., on business days from Monday to Friday, between 7:00 a.m. and 3:00 p.m.
MaxiEcu (2) – software version only for Windows (with green background), software released until 2023, licensed by MaxiEcu Sp. z o. o. based in Gdynia. New MaxiEcu / MaxiEcu (3) – software in Windows and Android versions,, software released from 2024, licensed by MaxiEcu Sp. z o. o. based in Gdynia in combination with an interface and a license for a selected range of brands. System requirements: Windows 10 (or newer), 64 bit and Android 8 (or newer). §3 Terms of the offer
Using the offer is completely voluntary .
The offer can only be used via the MaxiEcu User Account or directly at the organizer’s office.
The offer includes the purchase of a new interface model Batman_4GEN, which will be a new hardware key for the new MaxiEcu and for the existing MaxiEcu (2) license, replacing the existing MPM-COM interface (the MPM-COM interface is permanently removed from the account and the license). For example: The user has MPM-COM interface no. XXX, which is the hardware key for the MaxiEcu (2) license with the Audi and BMW brands. After completing the order, the user will receive: a new Batman_4GEN interface no. ZZZ, with a full manufacturer’s warranty, which will be the hardware key for the new MaxiEcu license for the with the Audi and BMW brands and MaxiEcu (2) license with the Audi and BMW brands. At the same time, the MPM-COM interface no. XXX will be removed from the account and will no longer be a hardware key for the Audi and BMW brands – it only provides access to the OBD module with basic diagnostics.
Once the order is completed, the MPM-COM interface is permanently deleted from the User’s account and disconnected from the MaxiEcu (2) license. Only access to the OBD module remains active on the deleted MPM-COM interface. The MPM-COM interface (with access only to the OBD module) may be sold, transferred, or otherwise made available to another person. In such a case, the User should notify the Organizer of the details (email) for the creation of a new User account. This notification must be submitted through the User’s account. The Organizer is not responsible for any sale/transfer/transfer transaction.
After introducing the new model Batman_4GEN interface, the User has the standard option of purchasing an extension of the MaxiEcu (2) license with a new brand (order by sending a form on the User’s account with information about which brand is required) or/and gains the option of purchasing an extension to the new MaxiEcu license. For example, the User has a model Batman_4GEN interface no. ZZZ, which is the hardware key for the new MaxiEcu license for the with the Audi and BMW brands and MaxiEcu (2) license with the Audi and BMW brands. -> The user can order a new brand , e.g. Citroen for the new MaxiEcu license. As a result, he will have : new MaxiEcu licenses for the Audi , BMW Citroen brand and MaxiEcu (2) with the Audi, BMW, brands -> The user can order a new brand , e.g. Citroen for the MaxiEcu (2) license. The offer price visible in the account takes into account the discount from the regular price for the purchase of a given interface model.
The offer does not include the shipping price . The shipping cost depends on the country and delivery method. The domestic shipping price list is in accordance
with the price list on the Organizer’s store website: https://shop.maxiecu.eu/shop/footer/delivery . The international shipping price is displayed when ordering , after selecting the delivery country. In the event of the lack of availability of a given country on the list of countries to choose from – please contact us at shop@maxiecu.com
The Organizer is not responsible for any difficulties in delivering the order resulting from providing incorrect or incomplete address data. There is also no influence on the time of delivery or its course (including, for example, delays , difficulties on the part of the carrier , destruction or loss). Any comments regarding the delivery should be directed directly to the carrier carrying out the delivery .
When ordering, the User indicates their preferred payment method . The order is accepted after the payment has been recorded /confirmed by the selected payment system. The order will be automatically canceled if payment is not received by the end of the next calendar day from the date of order placement.
After the payment has been recorded / after the payment has been confirmed by the selected payment system ( does not apply to cash on delivery shipments), the order will be prepared for shipping and will be transferred to the selected carrier on the same day or at the latest on the next business day during the working hours of the Sales Department , i.e. working days from Monday to Friday , between 7:00 a.m. and 3:00 p.m.
The User may cancel the order until the shipment is dispatched ( handed over to the carrier ) by the Organizer.
A given User may use only one variant of the offer, i.e. the offer ” Replacing the MPM-COM interface with the Batman_4GEN model <basic offer>” or “Replacing the MPM-COM interface with the Batman_4GEN model + NEW MaxiEcu license <special offer>”. In the event of placing an order for both offers, only the one for which payment is recorded first will be implemented .
The Organizer may refuse to make a purchase under the terms of the offer if the User fails to comply with or violates the provisions of these Regulations.
By using the offer, the User confirms his/her consent to the execution of the order in accordance with the Regulations of the Organizer’s online store (https://shop.maxiecu.eu/shop/footer/terms ).
The new MaxiEcu license is a digital product delivered online (the service is delivered in its entirety, along with order fulfillment), which, in accordance with applicable regulations, is subject to a limited return policy. By using this offer, the User agrees to the full performance of the service within 14 days, and therefore, the right to withdraw from the contract is lost.
§5 Warranty
The Batman_4GEN model is covered by a 2-year manufacturer’s warranty. The terms of complaints under the warranty, in accordance with the Regulations (ttps://shop.maxiecu.eu/shop/footer/terms ) and information on the Organizer’s store website.
§6 Personal Data
The controller of personal data in the scope of execution of sales agreements is : MaxiEcu Sp. z oo with its registered office in Gdynia (81-589) at 7 Fleszarowa-Muskat Street , entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court of Gdańsk – Północ in Gdańsk under the KRS number 0001080295, NIP: 5862323620, REGON: 36849635500000
User ‘s personal data will be processed in accordance with the principles set out in the Personal Data Protection Act and other generally applicable legal provisions .
Data will be processed for the purpose of fulfilling the offer. Each User has the right to access the content of their data, correct it and request its deletion . Providing data is voluntary, but necessary to fulfill the order as part of the offer.
The Administrator may entrust the processing of personal data to other entities, to the extent necessary to fulfill the order , i.e. for example, to deliver parcels with the ordered product. Users ‘ personal data are not transferred outside the European Union.
Data are made available to state authorities in cases provided for by law.

§7 Final provisions
The User declares that he / she has read the Regulations and accepts them without reservations . In the event of any doubts as to the provisions of the Regulations , the User has the right to contact the organizer at any time for a proper interpretation of their provisions .
The competent court to resolve any disputes arising from the application of the Regulations is the court with jurisdiction over the seat of the organiser .
The offer does not constitute a game of chance or a mutual bet within the meaning of the Act of 19 November 2009 on gambling (Journal of Laws No. 201, item 1504, as amended)
These Regulations will be available throughout the duration of the offer from the organizer and visible in the User’s account in the offer description.
